I. PURPOSE OF THE DOCUMENT

These „General Terms and Conditions for Participation in Events Organized by Looking for God” (hereinafter referred to as the „General Conditions”) establish the content of the agreement, including the rights and obligations of the parties, entered into between the participant and the event organizer.

II. DEFINITIONS

Capitalized terms used in the General Conditions shall have the following meanings:

Organizer – the „Looking for God” Christian ministry, with the legal entity administering the ministry being the DEOrecordings Association,

Association – DEOrecordings Association, a registered association with its registered office in Malinka 65D/2 Street, Wisla (43-460), Poland. The Association is an interdenominational Christian organization cooperating with churches and organizations whose aim is to bring people closer to the Gospel. Event– a conference, camp, training, workshop, or other meeting format organized by the Organizer, which requires the participant’s personalized registration, regardless of whether participation in the Event is paid or unpaid.

Participant – an individual registered (enrolled) for the Event. Minor participants are registered by parents/legal guardians.

Contractual Service – activities provided to the Participant according to the program of the specific Event, under the terms specified in these General Conditions.

Volunteer – an individual who, in the preparation and implementation of the Event, voluntarily and without remuneration performs services for the Association based on the provisions of the April 24, 2003 Act on Public Benefit Activity and Volunteer Work (Polish Journal of Laws of 2018, item 450, as amended).

Registration System or System – the functionality provided on the event-related website that enables the registration process for participants of the Event.

User– any person utilizing the System to register for the Event.

Conclusion of Event Participation Agreement  – the moment when the Organizer sends the User a confirmation to the email address provided during registration, indicating that the registration was accepted and participation in the Event was approved.

Privacy Policy  – the applicable rules for handling personal data of users of services administered by the Organizer, available at https://szukajacboga.pl/polityka-prywatnosci/ (NOTE: use page translation please)

Terms and Conditions – the rules for the operation of the Looking for God internet platform, available at https://szukajacboga.pl/regulamin/ (NOTE: use page translation please)

III. PARTICIPANT REGISTRATION / PARTICIPATION CONDITIONS.

  • 1. To participate in the Event, one must:
    • a)complete the participation registration via the registration form available on the website related to the Event, and
    • b) for paid Events – make the payment in the amount and according to the terms specified separately for each Event in the Registration System.
  • 2. Participation registration for Events is conducted exclusively online through the Registration System.
  • 3. Technical requirements related to using the Registration System do not deviate from the technical requirements for using the Internet. The User must have a computer with internet access and software enabling the browsing of its resources.
  • 4. The scope of the System’s operation includes storing in the database the User’s registration and/or registrations made by them, as well as managing this registration by the Organizer.
  • 5. The participation registration lasts until the allocated spots are filled, but not longer than the date determined by the Organizer, as communicated in the Registration System and/or on the Event’s website – if such a page has been launched.
  • 6. To successfully register in the System, the User is obliged to complete all fields marked as mandatory. These are typically marked with an asterisk (*).
  • 7. The User confirms that all data provided in the Registration System is accurate.
  • 8. Completing the registration process requires the User to declare that they have read and accepted the content of the General Conditions (consent to conclude the Event participation agreement), which also includes consenting to the processing of personal data for purposes related to the implementation of the Contractual Service.
  • 9. After successful verification of the registration, a confirmation message of receiving the registration and concluding the Event participation agreement will be sent to the email address provided in the registration form.
  • 10. The number of available spots for participation in the Event is limited. In exceptional cases, the Organizer reserves the right to qualify Participants for the Event according to criteria other than the order of registrations.

IV. ORGANIZER’S RIGHTS AND OBLIGATIONS

  • 1. The Organizer makes every effort to ensure the execution of the Contractual Service according to the description of the Event specified in the Registration System and/or on the Event’s website (if such a page has been launched).
  • 2. The Organizer reserves the right to change the date of the Event due to reasons beyond their control. In such a case, withdrawal from participating in the Event can be done at no cost. However, the Organizer does not cover additional costs incurred by the Participant in connection with the Event.
  • 3. The Organizer reserves the right to change speakers and/or the program when it results from reasons beyond their control. In such a case, the Participant does not have the right to compensation from the Organizer.
  • 4. The Organizer commits to using the personal data provided by the User solely for the purposes and under the rules specified in Section VI of these General Conditions.
  • 5. The Organizer is not liable for cases of unavailability of the Registration System caused by a telecommunication system failure and for other consequences of faulty telecommunication connections and damages caused by them.
  • 6. The Organizer is not responsible for the belongings of Participants that may be lost, damaged, or stolen during the Event.

V. PARTICIPANT’S RIGHTS AND OBLIGATIONS

  • 1. The Participant has the right to participate in all parts of the program of a given Event and to use additional services provided in this program or made available by the facility administrator where the Event takes place.
  • 2. During the Events, we strive to create a pleasant and courteous atmosphere, therefore all Participants are obliged to:
      • a) refrain from actions that may hinder or disrupt the functioning of the Event, especially actions that may hinder the use of the Event by other Participants;
      • b) refrain from actions that may violate the privacy of other Participants, especially collecting, processing, and disseminating information about other Participants without their explicit consent;
      • c) refrain from actions that may tarnish the reputation of the Organizer, the Association, and cooperating entities;
      • d) comply with legal regulations, principles of social coexistence, and good manners;
      • e) adhere to all specific rules or regulations specified for a particular Event;
      • f) refrain from consuming alcohol and possessing or using any psychoactive substances.
  • 3. Participants bear full material responsibility for any damages caused by them, both on the premises where activities related to the Event are carried out and in accommodation places.
  • 4. During the Event, the Participant must follow any orders given by the Organizer and their representatives, including Volunteers. This particularly applies to the prohibition of recording images, sound, and/or photographing the speeches of speakers.
  • 5. Participants are obliged to comply with the regulations applicable to the venue where the Event is held, including safety rules, occupational health and safety regulations, and fire regulations.

VI. PROCESSING OF PERSONAL DATA

  • 1. Personal data of Participants and Volunteers is processed based on the legal provisions on personal data protection and the principles specified below, without prejudice to the specific regulations applicable to all activities of the Association, including the Privacy Policy and the Looking for God Platform Regulations.
  • 2. In compliance with Article 13(1) and (2) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as „Regulation 2016/679”), the Organizer informs as follows:
      • a) Data Controller: DEOrecordings Association, with its registered office in Wisla (43-460), Malinka 65D/2, Poland (hereinafter referred to as „Data Controller”)
      • b) Data Protection Officer: A Data Protection Officer has been appointed by the Data Controller, and they can be contacted at the email address: iod@SzukajacBoga.pl or by sending correspondence to the address of the Data Controller with the note „DPO.”
      • c) Purposes and rules for processing personal data of the Participant are as follows:
        • Entering into a contract (contract for the use of the Contractual Service):
          Scope of data: identification and contact details (name, surname, date of birth, address, email address, phone number)
          Legal basis: Article 6(1)(b) of Regulation 2016/679, i.e., processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract
          Duration of data processing: for the duration of the contract, most commonly until the completion of the Service, and in specific situations for a period arising from applicable legal regulations, including the limitation period for any claims related to the performance of the contract or mandatory documentation for tax authorities – depending on which of these periods is longer
          Rights related to data processing: right to access personal data, right to rectification of personal data, right to request from the data controller restriction of processing of personal data, right to erasure of personal data, right to data portability, right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, right to lodge a complaint with a supervisory authority – President of the Office for Personal Data Protection
          Obligation to provide data: contractual requirement. The consequence of not providing data will be the inability to conclude a contract for the provision of the Contractual Service and thus the inability to participate in the Event.
        • Promotion of the activities of the Data Controller – Participant’s image (photos, videos, and audio recordings taken during the Event):
          Scope of data: Participant’s image (photos, videos, and audio recordings taken during the Event)
          Legal basis: separate consent. The legal basis is Article 6(1)(a) of Regulation 2016/679, i.e., the data subject has given consent to the processing of his or her personal data for one or more specific purposes
          Duration of data processing: until the consent for processing this data is withdrawn
          Rights related to data processing: right to access personal data, right to rectification of personal data, right to request from the data controller restriction of processing of personal data, right to erasure of personal data, right to data portability, right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, right to lodge a complaint with a supervisory authority – President of the Office for Personal Data Protection
          Obligation to provide data: providing data is voluntary and does not affect the possibility of participating in the Event; however, it is necessary to achieve the specified purpose of processing.
        • Informing the Participant about other Events and initiatives of the Data Controller (offering the opportunity to use other services and content in the future):
          Scope of data: Participant’s contact details (name, surname, email address, phone number)
          Legal basis: Article 6(1)(f) of Regulation 2016/679, i.e., processing is necessary for the purposes of the legitimate interests pursued by the data controller
          Duration of data processing: until an objection to the processing of data for this purpose is raised
          Rights related to data processing: right to access personal data, right to rectification of personal data, right to request from the data controller restriction of processing of personal data, right to object to processing of personal data, right to lodge a complaint with a supervisory authority – President of the Office for Personal Data Protection
          Obligation to provide data: providing data is voluntary and does not affect the possibility of participating in the Event; however, it is necessary to achieve the specified purpose of processing.
        • Additional services for the Participant – data will be processed to possibly adapt the way of providing the Contractual Service to the individual needs or preferences of the Participant:
          Scope of data: determined by the data subject. This refers to any data provided by the User at their discretion (not required or specified by the Data Controller), e.g., in particular in the fields of the registration form described as „Other” or „Comments”
          Legal basis: separate consent. The legal basis is Article 6(1)(a) or – in the case of special categories of data – Article 9(2)(a) of Regulation 2016/679, i.e., the data subject has given consent to the processing of his or her personal data for one or more specific purposes
          Duration of data processing: until the consent for processing this data is withdrawn
          Rights related to data processing: right to access personal data, right to rectification of personal data, right to request from the data controller restriction of processing of personal data, right to erasure of personal data, right to data portability, right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, right to lodge a complaint with a supervisory authority – President of the Office for Personal Data Protection
          Obligation to provide data: providing data is voluntary and does not affect the possibility of participating in the Event; however, it is necessary to achieve the specified purpose of processing.
      • Personal data will not be transferred to other entities, except to entities authorized to process them under the provisions of applicable law and to entities providing services necessary for current operations, with whom the Data Controller has concluded agreements for the processing of personal data, in accordance with Article 28 of Regulation 2016/679;
      • In connection with the tools used by the Data Controller to manage the database, the personal data of the Participant may be processed in third countries within the meaning of Regulation 2016/679.       • The personal data of the Participant will not be used to make decisions based solely on automated processing, including profiling.
  • 3. In order to exercise the rights mentioned above, an appropriate request must be submitted:
    • by email – to the address iod@SzukajacBoga.pl or
    • by traditional mail to the address: DEOrecordings Association, Malinka 65D/2, 43-460 Wisla, with the note „DPO.”

VII. FINAL PROVISIONS

  • 1. The provisions of the „General Conditions of Participation in Events organized by Looking for God” regulate the rules for the execution of the Contractual Service, are an integral part of the registration of participation in the Event, and apply to all Participants.
  • 2. Neither Party (i.e., the Participant nor the Organizer) can transfer the rights arising from the General Conditions to a third party without the written consent of the other Party.
  • 3. The Organizer reserves the right to use the email address and/or phone number provided by the Participant during registration for the Event to convey important organizational information about the Event to the Participants, including changes to the program.
  • 4. The Participant acknowledges that any events or incidents that violate the provisions of the General Conditions may be the basis for the Participant’s denial of the right to participate in the Event and a request to leave the Event’s premises or the venue’s premises where the Event is held without compensation and reimbursement of costs associated with participating in the Event.
  • 5. The Organizer reserves the right to make changes to the „General Conditions of Participation in Events organized by Looking for God.”
  • 6. In the event of changes to the General Conditions, Users will be notified by placing them on the Registration System’s website.
  • 7. After the Organizer announces changes to the General Conditions, each Participant who has registered for the Event should promptly familiarize themselves with the changes. In case of non-acceptance of the changes to the General Conditions, the Participant should notify the Organizer in writing about this decision using electronic communication means to the address kontakt@SzukajacBoga.pl. This statement should reach the Organizer no later than 14 days from the date the amended General Conditions come into effect. If the Organizer does not receive the Participant’s statement of non-acceptance of the changes to the General Conditions within the above-mentioned period, it is assumed that the Participant has accepted the changes to the General Conditions.
  • 8. Disputes arising in connection with the execution of the Contractual Service will be resolved amicably.
  • 9. In the absence of an amicable settlement, disputes between the Parties to the agreement will be subject to the jurisdiction of the court having jurisdiction over the registered office of the DEOrecordings Association.
  • 10. In all matters not regulated in this document, the relevant provisions of the Civil Code of Polish Law apply.
